Terms of Service

These Terms of Service (“Terms”) govern your access to and use of LevelUpTimes.com (the “Site”), operated by Level Up Times (“LUT”, “we”, “us”, “our”), an Australian sole trader. By accessing the Site or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 13 years of age to use the Site. By creating an account, you confirm that you meet this requirement. If you are under 18, you should have parental or guardian consent before using the Site.

2. Accounts

Registration

To access member features — including live streams, community chat and comments, discussion areas, and your personal game library — you must create an account. Registration requires only a username and a valid email address. You are not required to provide your real name or any other personal identifying information.

Passwords

You are responsible for choosing a strong, unique password and for keeping your login credentials confidential. We do not store passwords in plain text. Passwords are processed using industry-standard one-way hashing. We will never ask for your password outside of the Site’s login form.

Account responsibility

You are responsible for all activity that occurs under your account. If you suspect unauthorised access, notify us immediately at hi (at) leveluptimes (dot) com. We reserve the right to suspend or terminate accounts that violate these Terms.

One account per person

Creating multiple accounts to circumvent bans, restrictions, or community rules is not permitted.

3. Email and Push Notification Communications

By creating an account, you agree that we may contact you by email for transactional purposes, including account confirmations, password resets, and other service-related notices. These communications are part of the service and cannot be opted out of while your account is active.

With your opt-in consent, we may also send you:

Newsletters and editorial content from Level Up Times
Marketing and promotional communications via email or push notification

You may opt out of newsletters, marketing emails, and push notifications at any time by visiting your account page at leveluptimes.com/profile. Opting out will not affect transactional communications.

4. Features and Services

Live streams

Registered members may access live video streams hosted on the Site. Stream access may vary by membership tier. Streams are subject to availability, and we do not guarantee uninterrupted access. We may archive streams for on-demand viewing at our discretion.

Editorial content

The Site publishes news, reviews, analysis, and commentary about videogames and the games industry. This content is provided for informational and entertainment purposes and reflects the editorial opinion of Level Up Times.

Chat, comments, and discussion

Registered members may participate in live stream chat, leave comments on articles, and engage in community discussion areas. By participating, you agree to our Community Standards (Section 6). We may moderate, edit, or remove content that violates these Terms at any time without notice.

Game library

Members may maintain a personal game library using our game database, which is powered by third-party sources. You can add titles, set status, and track your collection. Game data — including titles, metadata, and how long to beat information — is sourced from third-party providers. We do not claim ownership of this data and make no warranty, express or implied, as to its accuracy, completeness, or fitness for any purpose. This data is provided as-is.

We may use your game library and console library data in aggregate, de-identified form to help grow Level Up Times and to work with our marketing or advertising partners. This use will not identify you personally.

5. Acceptable Use

By using the Site, you agree not to:

Post content that is unlawful, defamatory, harassing, threatening, hateful, or discriminatory
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Spam, flood, or disrupt chat, comments, or discussion areas
Share another person’s private or personal information without their consent
Upload or transmit malicious code, viruses, or harmful content
Attempt to gain unauthorised access to any part of the Site, accounts, or our infrastructure
Use automated tools, bots, or scrapers on the Site without our written permission
Use the Site for any commercial purpose without our express written consent
Reproduce, distribute, or republish LUT editorial content without permission (see Section 8)

6. Community Standards

Level Up Times is a community built around a shared love of games. We want it to be a space where people feel welcome regardless of their background, experience level, or taste in games. As a member, we expect you to:

Engage respectfully, even in disagreement
Keep discussion relevant to the topic or context
Not use slurs, hate speech, or language intended to demean or exclude
Not post spoilers without appropriate warnings
Not solicit personal information from other users

We reserve the right to moderate, remove, edit, or restrict any content or user account at any time, at our sole discretion. This right is not limited to legal or regulatory reasons and extends to content or conduct we consider disreputable, misleading, harmful, invalid use of our service, or otherwise inconsistent with the spirit of this community. Moderation decisions may include a warning, temporary suspension, or permanent account termination.

7. User-Generated Content

By submitting comments, chat messages, discussion posts, or other content to the Site (“User Content”), you grant Level Up Times a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content on the Site and in related promotional materials.

You retain ownership of your User Content. You represent and warrant that your User Content does not infringe any third-party intellectual property rights and does not violate any law.

We do not endorse any User Content and take no responsibility for it. If you believe content on the Site infringes your rights, please contact us at the details in Section 13.

8. Intellectual Property

All editorial content, branding, design, software, and other materials on the Site are the property of Level Up Times or our licensors and are protected by Australian and international intellectual property laws.

You may not reproduce, redistribute, or republish our content without written permission, except for brief quotation with attribution for the purposes of commentary, criticism, or news reporting consistent with fair dealing under Australian copyright law.

Game titles, artwork, trademarks, and related assets referenced on the Site remain the property of their respective owners. LUT makes no claim of ownership over third-party game properties.

9. Third-Party Data and Services

The Site may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of those sites. Linking does not constitute endorsement.

Game data on the Site — including game database entries, metadata, and how long to beat information — is sourced from sources such as the IGDB (Internet Game Database). Level Up Times does not claim ownership of, and expressly disclaims all responsibility and warranty for, third-party data. This data is provided for informational purposes only, and we accept no liability for any inaccuracies, omissions, or changes in that data.

10. Disclaimer of Warranties

The Site and all content, features, and services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

To the extent permitted by Australian consumer law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes any rights you may have under the Australian Consumer Law that cannot be excluded by contract.

11. Limitation of Liability

To the fullest extent permitted by law, Level Up Times shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, including loss of data, loss of profits, or service interruption.

Our total liability to you for any claim arising out of these Terms or your use of the Site shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Termination

You may close your account at any time by contacting us or using account settings on the Site. Upon closure, your access to member features will end at the conclusion of your current billing period.

We may suspend or terminate your account immediately if you breach these Terms, engage in conduct harmful to the community or the Site, or if we are required to do so by law. We will endeavour to notify you of the reason for termination where possible.

Upon termination, your right to use the Site ceases immediately. Sections 8, 9, 11, 12, and 15 survive termination.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

15. Changes to These Terms

We reserve the right to update these Terms of Service at any time. When we do, we will revise the “Last Updated” date at the top of this page. Where changes are material, we will notify you by email or a prominent notice on the Site. Continued use of the Site after changes take effect constitutes your acceptance of the updated Terms.
